Terms of Use for QuickFeed

1. Acceptance of Terms

By downloading, installing, or using QuickFeed (hereinafter the "Service"), you agree to be bound by these Terms of Use (hereinafter the "Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legal agreement between you and QuickFeed Company (DUNS 28-454-1152), located at 60 RUE FRANCOIS IER, 75008 PARIS, France.

We reserve the right to modify these Terms at any time. Changes will be posted within the application or on this page with an updated date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

2. Description of the Service

The Service aggregates news article titles, publication dates, and links to original articles from various third-party sources available on the internet. The Service is provided "as is," without any warranty of accuracy, reliability, or continuous availability.

2.1 Automatic News Refresh

The Service aggregates only news articles published within the last 7 days to ensure the relevance and timeliness of the content provided. News older than 7 days is not included in the aggregation.

The Service is designed to automatically refresh news content every hour. However, the actual refresh time may vary by a few minutes due to various factors, including but not limited to network conditions and device performance. Additionally, the automatic refresh feature may be interrupted or disabled based on the settings of the device on which the Service is installed. It is the user's responsibility to ensure that their device settings allow for the automatic refresh to function properly.

3. Premium Subscription (not available for the moment)

3.1. Subscription Terms

The premium subscription is a paid option that unlocks advanced features of the Service. It is managed exclusively through the Google Play Billing System and is subject to the Google Play Terms of Service available here.

3.2. Payment and Renewal

Payments are processed by Google Play. The subscription automatically renews at the end of each billing period unless you cancel it through your Google Play account before the renewal date. We reserve the right to change the subscription fees, with at least 7 days' notice provided via the application.

3.3. Refund Policy

A full refund is available within 7 days of the initial purchase of the premium subscription. To request a refund, contact us at alboucher@quickfeed.info or use the refund options available through Google Play. No refunds will be issued after this period, except where required by law.

3.4. Cancellation

You may cancel your subscription at any time through your Google Play account. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate your access to the Service for any violation of these Terms.

4. Authorised Use

You agree to use the Service in compliance with all applicable laws, including the General Data Protection Regulation (GDPR) and French law. It is prohibited to:

• Use the Service for illegal or unauthorised purposes;
• Attempt to access the Service's systems or data without authorisation;
• Use automated tools (e.g., bots, scrapers) to extract content;
• Disrupt or interfere with the normal operation of the Service.

In the event of a breach of these rules, we reserve the right to suspend or terminate your access to the Service without notice or refund.

5. Intellectual Property

5.1. Third-Party Content

The Service aggregates titles, dates, and links from third-party sources. We do not claim any ownership rights over this content, which remains the responsibility of its respective authors or publishers. You must respect the copyright and terms of use of the source websites when accessing content through the Service.

5.2. Application Ownership

The user interface, source code, and graphical elements of the Service are the exclusive property of QuickFeed Company and are protected by French and international intellectual property laws. Any reproduction, modification, or distribution of these elements without prior written permission is strictly prohibited.

5.3. Removal Requests for News Sources

If a news website or content provider does not wish to have their content (titles, publication dates, or links) referenced or displayed by the Service, please address your request at alboucher@quickfeed.info.

6. Data Collection

The Service collects only the following data:

• News search queries, cached locally on your device;
• Subscription data managed by Google Play (e.g., subscription status).

No personally identifiable information is collected directly by us, and no user accounts are required. For more details, please refer to our Privacy Policy.

7. Limitation of Liability

To the extent permitted by French law, the Service is provided without any implied warranty of quality or fitness for a particular purpose. Our liability for any direct damages is limited to €100. We are not liable for indirect damages, such as loss of data, profits, or opportunities, except in cases of gross negligence or intentional misconduct on our part.

8. Modification of Terms

We may modify these Terms at any time. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

9. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute arising from the use of the Service shall be subject to the exclusive jurisdiction of the French courts.
